01/06/2007 - Success in the High Court for ISB South Africa

The High Court of Pretoria, South Africa, has on Friday 01 June 2007, ruled in favour of ISB's Director Riaan Venter. Lejara and their directors Lucas Mothupi, Kurt Lindoor, Wim du Preez, Hannes Louw and Ryno Abrie incorrectly alleged and accused Riaan of working at Macsteel International which they believed was one of their existing clients, and he was thereby contravening a previous Court settlement reached on 21 September 2006. Lejara and their Directors asked the Court to sentence Riaan to 30 days imprisonment for supposedly contravening the Court settlement.

Macsteel declared in a sworn testimony that they are not and were not Lejara’s client, and that they will never be a client of theirs. This testimony and other independent supporting testimonies, proof, and evidence have proven to the Court that Riaan did not contravene the previous Court settlement reached on 21 September 2006 and therefore the Contempt of Court application by Lejara, was dismissed by the High Court, with all costs being that for the account of Lejara and their Directors.

22/09/2006 - South African company brings urgent Court application against 3 previous employees.

Lejara Enterprise Solutions and Lejara Business Intelligence and their Directors Lucas Mothupi, Kurt Lindoor, Wim du Preez, Hannes Louw and Ryno Abrie brought an urgent Court application in the High Court of Pretoria in South Africa, to prevent 3 Business Intelligence consultants Lourie Louw, Riaan Venter and Vassan Naidoo, who previously worked for them, from working at a “potential” client of theirs, namely the PG Group in South Africa.

This application was brought since Lejara stated that the 3 individuals were contravening a “Restraint of Trade” clause in their employment contracts by working at one of their clients or potential clients. The 3 consultants opposed the application and have proven that they were not contravening the employment agreements, and have also proven with independent sworn affidavits that the PG Group was not a client of Lejara.

A Court settlement was reached between the parties, where Lejara and their Directors acknowledged and agreed that the PG Group was not their client, thereby allowing the 3 consultants to continue to work at the PG Group.

As part of the settlement reached the consultants undertook not to work for a period of 1 year from 1 September 2006 at any of Lejara’s existing clients as on the 1st of September 2006. Furthermore, no client list was agreed upon in the settlement except to agree that the PG Group was not their client. Both parties had to pay their own legal costs.
